Our Distressed Assets Group advises international and domestic financial institutions, including distressed asset funds, special situations funds, investment, commercial and retail banks as well as asset managers and debt collection agencies involved in arranging and executing distressed asset transactions both in and through Ireland.

The nature of such transactions usually involves advising on each of the taxation, banking and financial services, regulatory, insolvency, corporate and capital markets elements of both domestic and cross-border structures and results in our working closely with arrangers, originators, managers and law firms in jurisdictions throughout the world.

We also undertake due diligence on distressed asset portfolios in Ireland and advise on all relevant structuring, tax, legal and regulatory issues.

We have advised in relation to:

  • the disposal by a domestic Irish bank of an Irish portfolio of commercial, buy-to-let and residential mortgage loans with a nominal value of approximately €650 million
  • the financing by an international investment bank of the acquisition of an Irish portfolio of non-performing and sub-performing residential mortgages originated by GE Woodchester Capital Home Loans and with a face value of approximately €600 million
  • the transfer by a domestic Irish bank of a €1.1 billion mortgage loan portfolio to its pension fund
  • the financing and acquisition by an international investment bank of a UK portfolio of performing commercial mortgages from Bank of Ireland with a face value of more than £1 billion
  • the financing by way of securitisation of an Irish portfolio of performing auto-loan receivables originated pursuant to hire purchase and lease agreements
