General Court considers Community equivalent of US ‘Morehouse defence’

In Argo Group International Holdings Ltd v Office for Harmonisation in the Internal Market (OHIM) (Case T247/12, May 20 2014), the General Court has upheld the decision of the Second Board of Appeal of OHIM that there was a likelihood of confusion between the figurative marks ARIS and ARISA ASSURANCES S.A.
