Some recent Global Mobility work highlights include advising:

  • on issues associated with structuring inbound and outbound cross-border assignments of employees (working closely with international law firms) such as immigration, tax (including permanent establishment and social security), employment and regulatory matters;
  • organisations operating in unique environments (including financial services organisations, energy and infrastructure, cultural institutions, sporting organisations and education institutions) on devising unique immigration strategies to suit their talent attraction and retention needs
  • clients on the employment aspects of global mobility, including drafting employment contracts, advising on the rights of employees while engaged in Ireland and providing employment law advice in respect of employment law claims brought by assignees, having regard to the unique risks arising in such circumstances, on employee versus independent contractor tax issues;
  • clients in all areas of corporate immigration including advising in respect of entry, residence and work requirements, analysis of appropriate immigration strategies, the Irish tax aspects of applying for / renewing employment permits, challenging decisions and strategic and logistical support through all stages of the process;
  • clients in all areas of understanding the tax aspects of global mobility, including on shadow payroll arrangements, payroll correction issues, taxation of C-suite executives, double tax issues associated with cross-border employment arrangements, Ireland’s special assignee relief programme (SARP), obtaining releases for clients from the obligation to operate the Irish payroll tax system for foreign based employees posted temporarily to work in Ireland, obtaining A1 certificates of coverage, obtaining payroll exclusion orders, taxation of share based remuneration for cross-border employees (covering extent of liability to tax in Ireland, double tax issues, manner of inclusion in payroll, employer annual share based remuneration reporting filings, etc);
  • clients on the requisite corporate structures required for a globally mobile workforce, including advising on inward investment projects, and working with international companies on the establishment, expansion, and operation of their business in Ireland;
  • clients on navigating regulatory environments applicable to them, including but not limited to providing expert guidance in dealing with the Central Bank of Ireland requirements in relation to global mobility strategies;
  • clients on navigating requirements concerning the transfer of data across borders, including requirements associated with compliance in an increasingly regulated space; and
  • on immigration and citizenship applications for high-net-worth individuals, as well as providing sophisticated cross-border legal and tax planning services to such individuals who are relocating to Ireland for the short or long term.
